Changes could be coming to laws governing overtime

Employers in Miami are subject to certain rules when it comes to paying their employees. One such regulation governs how overtime is paid. At Welbaum, Guernsey, Hingston, Gregory & Black, L.L.P., we understand that compliance with the law is important to you as a business owner.

A bill has recently passed the House which aims to overhaul the federal requirements for overtime, reports CNN Money. While there are both federal laws and state laws regarding wages, whichever one that benefits the employee the most is the one you must follow as an employer. The bill proposes to allow employers to offer paid time off as an alternative to paying time-and-a-half for work hours that exceed 40 hours per week. For every one hour of overtime worked, an employee would be eligible to receive one and a half hours of paid time off.

Opponents of the bill argue that this would hurt employees since it would be up to company owners to decide when the paid time off could be used. They also worry that workers could be coerced into taking the time off rather than receive a bigger paycheck. However, those in favor of it point out that it gives employers much needed flexibility and that an employee would have to agree to the paid time off in lieu of receiving overtime.
