Condo complex subject of real estate litigation

Real estate developments can include many complexities. Whether residential or commercial buildings, the issues that can arise are many and can affect developers, builders, tenants and more. Florida companies involved in building and related business matters understand the importance of fair trade practices and clear contracts. When business disputes concerning such contracts arise, sometimes litigation is required to seek resolution.

Resolution of business litigation, however, may not always be finalized after an initial judgment. Plaintiffs in a case in South Carolina were recently awarded $55 million in damages but it is unknown if the defendants may appeal the decision. The damage award included $33 million in punitive damages and was related to a dispute involving a condominium complex that includes 13 separate buildings. The units were originally rentals but converted for sale as condos.

The plaintiffs alleged that the defendants did not properly convert the units which caused structural issues, water leaks, HVAC problems and more. The lawsuit detailed accusations of breach of warranty, breach of fiduciary duty, deceptive trade practices and more. The defense attorney was dismissed without giving any closing arguments prior to the jury beginning its deliberations. The settlement is one of the largest in real estate litigation in the area. Approximately 200 people live in the complex.

Any form of a contract dispute can have many nuances to it. What may seem clear at one point can change when evidence surfaces. The appeal process can be an important part of this as well. Persons or companies involved in business disputes may want to ensure experienced legal help is on their side.
